Venue Battle Looms in Walshe Murder Trial
Brian Walshe’s defense team announced plans to seek a change of venue in his upcoming murder trial. No doubt that he will argue that extensive media coverage may make it impossible to seat an impartial jury in Norfolk County.
Walshe is charged with killing his wife, Ana Walshe, in January 2023 and allegedly attempting to dispose of her remains. He has pleaded not guilty to charges of first-degree murder, misleading investigators, and improper disposal of a body.
Earlier this week, Judge Diane Freniere denied Walshe’s bid to suppress several incriminating Google searches and other digital evidence, ruling that prosecutors may present them at trial. This decision is a significant win for the prosecution and adds pressure ahead of the October trial.
Judge Raises Red Flag Over Federal Link
During a brief Zoom hearing on August 1, 2025, the presiding judge, Hon. Diane Freniere, disclosed a potential conflict of interest stemming from her close professional relationship with Michael Sullivan, an attorney recently hired by prosecutors to handle federal matters tied to the case.
Walshe appeared remotely from jail, and the Commonwealth and Walshe’s defense attorney Tipton appeared via Zoom.
Freniere states:
“If in fact you’d prefer I not resolve this issue relating to… we’ll call it the ‘federal materials’, as a result of the fact that the Commonwealth has chosen an attorney who I formerly worked closely with, then it seems to me that it might be best and most efficient for you to resolve this with Judge Crump and with the other cases”.
These matters reportedly involve coordination with the U.S. Attorney’s Office regarding possible Brady violations linked to State Trooper Michael Proctor’s conduct during the Karen Read investigation. Proctor’s conduct is now being scrutinized in the Walshe case as well as others. Sullivan’s role includes navigating these federal inquiries and ensuring proper evidence disclosure.
Countdown to October: What’s Next for the Case
The judge stated that while confident she could remain impartial, both sides should have the chance to request a different judge for this issue. Freniere stated that Judge Krupp
The hearing was continued to next week for further consultation. Attorney Tipton consulted with Walshe on the conflict immediately after the hearing.
The final pre-trial conference is scheduled for October 7th, with trial proceedings set to begin October 20th.
